1. Applicability

terms and conditions apply to every visit to and use of our website, as well as
to all offers, orders, and agreements between Lisa & Mark Toronto (“we/us”)
and you as the consumer (“you/your”).
1.2 By using the website or placing an order, you agree to these terms and to
our Privacy and Cookie Policy.
2. Conditions of Use & Orders
2.1 You
declare and guarantee that:
(a) you are a natural person aged 18 years or older;
(b) you are legally authorized to enter into a binding contract with us; and
(c) you are acting for personal, non-commercial purposes.
2.2 Complaints may be submitted in writing or by email to info@lisamark-toronto.ca.
2.3 Any warranties are void in cases of misuse, fraud, or violation of
applicable law.
2.4 An “order” constitutes your offer to purchase products under these terms,
and our email confirmation establishes the agreement.
2.5 If you are no longer permitted to use the website, you cannot place new
orders.
3. Personal Use
You may
only purchase products for personal and non-commercial use and not on
behalf of another person or entity.
4. Prices, Taxes & Errors
4.1 Unless
otherwise stated, all prices include VAT (if applicable) and exclude shipping
costs.
4.2 Import duties, customs fees, taxes, and other charges (for shipments
outside your customs area) are the buyer’s responsibility and are not
included in the product price. You are responsible for compliance with your
country’s import laws.
4.3 We make every effort to ensure accuracy. In the event of a clear pricing
or description error, we may correct or cancel the order and refund any
payments made.
4.4 Prices and availability are subject to change at any time.
5. Order Processing & Allocation
5.1 Orders
are processed on a “first come, first served” basis according to availability.
5.2 We reserve the right to cancel any order (for example, due to
unavailability or suspected fraud). In such cases, the full payment will be
refunded.
5.3 These terms form part of every agreement and supplement any applicable
promotional conditions.
6. Payment
6.1 Payment
can be made using the methods offered at checkout.
6.2 By completing payment, you confirm that you are the rightful owner or
authorized user of the payment method used.
6.3 If a payment fails or is reversed, we may cancel the order.
7. Delivery
7.1 We
deliver to the countries and addresses offered at checkout. The estimated
delivery time is displayed at checkout and in your order confirmation.
7.2 If a delivery attempt fails or the package is not collected in time, additional
costs may apply, or the order may be returned to us.
7.3 To the extent permitted by law, we are not liable for delivery delays
caused by circumstances beyond our control.
7.4 If an item is unavailable after ordering, we will inform you and offer
either a refund or a suitable alternative.
7.5 Estimated delivery time: typically 2–30 business days, in
exceptional cases up to 16 weeks, unless otherwise specified in the
product description.
8. Order Modification or Cancellation
8.1 As long
as your order has not been processed or shipped, you may request
modifications or cancellation by email.
8.2 Once your order has been processed or shipped, cancellation is no longer
possible; you may then proceed via the return process described in
Section 10.
9. Defective or Incorrect Items
9.1 Please
inspect your order upon receipt.
9.2 If you receive a defective or incorrect item, contact us within 7
days of delivery at info@lisamark-toronto.ca, including your order
number and clear photos.
9.3 After review, we will offer either a replacement or a refund (including
standard outbound shipping costs if legally required).
10. Right of Withdrawal, Returns & Refunds
10.1 You
have the legal right of withdrawal within 14 days after receiving
your order, without giving any reason.
10.2 We also offer a 30-day return period as a gesture of goodwill,
provided the item meets the conditions below.
10.3 Return conditions: items must be unworn, unwashed, with all
original tags attached and in original packaging. For hygiene
reasons, certain items (e.g., underwear) may be excluded; this will be clearly
indicated on the product page.
10.4 Return shipping costs are the customer’s responsibility, unless the
return is due to our error or a defective product. Please use a trackable
shipping method.
10.5 Once your return is received and inspected, we will issue a refund within 14
business days via the original payment method (excluding outbound shipping,
unless required by law).
10.6 Personalized or made-to-order products are not eligible for return
unless defective.
11. Discount Codes & Promotions
11.1
Discount codes are personal, non-transferable, non-exchangeable
for cash, and valid only within the specified period and conditions.
11.2 Discounts cannot be combined unless explicitly stated.
11.3 If part of an order is returned, the discount will be adjusted
proportionally.
12. Acceptable Use of the Website
12.1 You
may not:
(a) damage or impair the website’s functionality or availability;
(b) engage in illegal or harmful activities;
(c) upload or distribute malware or malicious code;
(d) use automated systems such as scrapers, bots, or spiders;
(e) bypass robots.txt instructions;
(f) use website data for unsolicited marketing;
(g) harass or mislead users;
(h) reverse-engineer or copy website code;
(i) benchmark or replicate our products or services;
(j) sell, sublicense, or rent access to the website;
(k) reframe or republish website content without permission; or
(l) place speculative, false, or fraudulent orders.

order amount or, if lower, the amount paid by our liability insurer.

or willful misconduct, or any liability that cannot legally be excluded.

You agree
to indemnify and hold harmless Lisa & Mark Toronto. from any
claims, damages, or losses arising from your unlawful use of the website or
violation of these terms.

In the
event of force majeure (including strikes, natural disasters, government
actions, transport disruptions, or power/network outages), we may suspend or
cancel our obligations without liability for resulting damages.

without prior notice, if deemed necessary.
23. Survival
Provisions
that by nature are intended to survive termination—such as Liability, Indenification,
and Intellectual Property—shall remain in full effect.

24.1 If any
clause is found invalid or unenforceable, the remaining provisions remain in
effect.
24.2 All rights and remedies under these terms are cumulative and not
exclusive of any other rights.
24.3 These terms do not create any enforceable rights for third parties unless
required by law.
25. Governing Law & Jurisdiction
These terms
and all related agreements are governed by Dutch law (without prejudice
to mandatory consumer protection laws in your country of residence).
Disputes shall be submitted to the competent court in Amsterdam, the
Netherlands, unless mandatory law requires otherwise.
